New Megaupload To Launch On Police Raid Anniversary
January this year the U.S. Government destroyed Megaupload, but founder Kim Dotcom is a not done with the file-hosting business yet and is preparing a comeback with something bigger and better. Over the past months a group of coders have been working hard on the new “Mega” venture and Dotcom announced today that the raid-proof service will launch exactly one year after Megaupload was shut down.
With 50 million visitors per day at its peak, Megaupload was one of the largest websites on the Internet.
This abruptly ended January this year when the U.S. Government took down the file-hosting service and had several key employees arrested including founder Kim Dotcom.
Despite ongoing criminal proceedings Dotcom and his team are determined to launch a new Megaupload, which will simply be called “Mega”.
Initially the new Mega was expected to launch in 2012, but according to the latest information the launch is now scheduled for January 19 2013, exactly one year after Megaupload was shut down.

FBI Must Return Kim Dotcom’s Illegally Seized Property
The New Zealand High Court has ordered the police to inspect all digital information illegally seized last year from Kim Dotcom’s mansion, and return everything not directly related to the ongoing prosecution. The judge further ruled that the FBI must ship back cloned drives that were sent to them, and destroy all copies the U.S. Government has archived.
Last year the search warrants used by police to raid the New Zealand home of Megaupload founder Kim Dotcom were ruled to be overbroad and illegal.
In addition, cloned copies of Dotcom’s hard drives sent to the FBI were deemed to have been unlawfully obtained.
After the ruling Dotcom’s legal team asked the court to order the return of Dotcom’s personal belongings, and in a ruling today Judge Helen Winkelmann did just that.

Kima Dotcoma?

Another victory for Kim Dotcom, he's getting all Megaupload data back
There are some stories in the IT world that just don’t go away. Apple VS Samsung is one that springs to mind. The recent leaking of celebrity photos will be another that, even if unknowingly responsible, Apple won’t be able to get away from for some time. Another is the arrest of Megaupload’s Kim Dotcom and programmer Bram van der Kolk, and the seizure of all their electronic data and hardware by the FBI.
While the case has been lumbering on since January 2012, with Kim Dotcom pleading innocence ever since, another small victory for the Kiwi and his company has been registered. Kim Dotcom gets his (users) data back.
Police have been ordered to release all clones of computer and electronic devices taken in the initial 2012 raid. While a wording of “as soon as reasonably practicable” is all the timescale Dotcom has to go on, there’s one factor that is being continually overlooked; the users (legitimate, nothing to hide users) who lost data might actually be able to reclaim what was once, and is still theirs.
Going back to Dotcom - who could still be extradited on piracy charges - he will get all clones back unencrypted, with the Court of Appeal stating that only two nominated and named New Zealand police officers will be provided any/all encryption codes, adding that they:
Cytat: | maintain the confidentiality of any and all encryption codes provided to me; will not transmit the encryption codes electronically; and will not disclose the encryption codes to any other person or any other party, and in particular to any representative of the Government of the United States of America. |
No small victory in this case, which at the moment could swing either way depending on what side of the bed solicitors and judges get out of on the day. But let’s just remember, this isn’t just a victory for Dotcom and van der Kolk, but a victory for the users who used Megaupload’s service and had their data taken without any reasonable distinction between what was legally there and what was not. |
