Iraq War vet faces 10 years in prison after photographing police

A 34-year-old Iraqi War veteran is facing ten years behind bars after photographing police officers in Austin, Texas that he says were mistreating a woman during a routine arrest on New Year’s Eve.

Antonio Buehler was pumping gas on December 31, 2011 when he witnessed officers with the Austin Police Department attempt to detain a woman under suspicion of driving under the influence of alcohol at a fueling station. By the end of the evening, though, Buehler also found himself being apprehended by authorities.
"I saw a woman getting assaulted by the police. It looked like police abuse, and I decided to speak up and take pictures. I think that is every person's right,” Buehler told Austin’s KVUE News earlier this year.

The authorities, however, see things differently. According to the officers, Buehler was interfering with their investigation. Buehler says he was simply exercising his First Amendment rights from afar, but the police department begs to differ.

Buehler was “in my face,” Officer Pat Oborski writes in the official police report. The officer also claims that Buehler spit at him, an allegation that Buehler rejects.
"The officer kind of put his hand on his shoulder and tried to back him up and at that time was when Buehler spit in the face of Officer Oborski,” Corp. Anthony Hipolito, an APD spokesman, told KVUE News earlier this year. “At that time he was placed under arrest for harassment of a public servant which is a third degree felony."

When all was said and done on January 1, Buehler was released from a holding cell after 16 hours behind bars. In the six months since the incident, the defendant has been trying to get to the bottom of things. Unfortunately for him, however, it’s been a fight that Austin officials have seemingly been all too unwilling to help with — a late January complained filed with the Austin internal affairs department was essentially ignored, and a letter he received last week informs him that he is forbidden to “view, possess or receive copies of the Internal Affairs Division’s investigation,” forcing him to face his felony charge hearing without little for him or his attorney to work with.

Spain’s government is drafting a law that bans the photographing and filming of members of the police. The Interior Ministry assures they are not cracking down on freedom of expression, but protecting the lives of law enforcement officers.

The draft legislation follows waves of protests throughout the country against uncompromising austerity cuts to public healthcare and education.

The new Citizen Safety Law will prohibit “the capture, reproduction and editing of images, sounds or information of members of the security or armed forces in the line of duty,” said the director general of the police, Ignacio Cosido. He added that this new bill seeks to “find a balance between the protection of citizens’ rights and those of security forces.”

The dissemination of images and videos over social networks like Facebook will also be punishable under the legislation.

Despite the fact that the new law will cover all images that could pose a risk to the physical safety officers or impede them from executing their duty, the Interior Ministry maintains it will not encroach on freedom of expression.

“We are trying to avoid images of police being uploaded onto social networks with threats to them and their families,” underlined Cosido.

The calls for camera disarmament come after an incident two weeks ago that seems to have shaken the Dallas Police Department. According to CBS Dallas-Fort Worth, a woman with the local police accountability group Cop Block was “following” a police officer, according to CBS Dallas-Fort Worth, recording him making traffic stops with a “video camera.”

“He was conducting traffic stops,” DPD Sergeant Derek McCarter told CBS-DFW. “The officer called for cover to further investigate. The woman refused information and gave leading answers.”

Dallas Police Association President Ron Pinkston said this business of taping police officers is worrisome, as these citizens could get hurt.

“It’s creating a major officer safety issue,” he said without further specifying incidents in which law-abiding citizens filming officers have created hazardous conditions.

A federal appeals court has ruled that Americans have the right to videotape police officers in public, thereby allowing a court case brought against New Hampshire police to progress.

Carla Gericke was arrested in 2010 for videotaping members of the Weare Police Department who pulled over her friend during a traffic stop. Her video camera malfunctioned, however, and she failed to record evidence of the incident.

Nevertheless, Gericke was arrested for disobeying a police officer, obstructing a government official, and "unlawful interception of oral communications," the court said. Concerning her failed efforts to record the incident, the court noted that the malfunction was irrelevant: "We agree that Gericke's First Amendment right does not depend on whether her attempt to videotape was frustrated by a technical malfunction. There is no dispute that she took out the camera in order to record the traffic stop."

China to film interrogations of suspects in push to halt police brutality

Chinese police will be required to film and record all interrogations in criminal cases to increase transparency, Xinhua reports. The new law states that the cross-examination process must be carried out fairly and the rights of suspects are respected.

The Ministry of Public Security introduced the law, while there are also plans to make the police more accountable, the Xinhua news agency said. The new decree also wants processes involving evidence gathering to be improved.

The law also includes a plan to improve evidence gathering and the accountability of the country’s 2 million police officers when handling cases.

Something I hope to encourage readers of Liberty Blitzkrieg to become aware of is their civil rights. Although the situation seems to have improved in recent years, many citizens remain woefully ignorant of their individual rights. Rights that were intentionally enshrined in the U.S. Constitution specifically to prevent the emergence of tyranny.

In our ever-changing modern technological world, the application of the Bill of Rights from time to time has needed a bit of clarification from the court system. One example of such was the 2011 case of Glik v. Cunniffe, in which the U.S. Court of Appeals for the First Circuit noted that: “videotaping of public officials is an exercise of First Amendment liberties.”

Apparently, this is rubbing certain Texas police officers the wrong way, and they found a willing lapdog to push their interests in Texas State Representative, Jason Villalba.

Mr. Villalba recently introduced bill HB 2918, which bans citizens unaffiliated with government licensed mainstream media outlets from filming police within 25 feet. It doesn’t take much thought to immediately recognize that this criminalizes filming an encounter with a cop who pulls you over, or any personal interactions with officers for that matter.
